California’s AIDS Funding Cuts would be, ‘Catastrophic,’ says AHF

‘Slash and Burn’ Approach is Wrong-headed Way for State to Handle Public Health Epidemic

Cuts—Including $96M from Lifesaving AIDS Drug Assistance Program—Would Trigger Vast Additional Lost Federal and Private AIDS Dollars; Proposal to Take All Money for AIDS Care and Treatment from General Fund Could be Death Sentence for Many Poor Californians

AIDS Healthcare Foundation (AHF), the nation’s largest non-profit HIV/AIDS healthcare provider, today criticized California state officials for planning draconian budget cuts that will jeopardize the public health by eliminating all funding for AIDS care and treatment from the state’s General Fund. The state action came on the heels of Tuesday’s state election where five ballot measures to address the state’s burgeoning budget deficit were voted down and; as a result, in response to the $21 billion and growing deficit now facing California.

“The fact remains that AIDS is a communicable disease. California’s slash and burn approach to eliminating funding for the care and treatment of those afflicted by this public health epidemic is totally wrong-headed. As a result of its actions, the state could actually end up killing many poor Californians living with HIV/AIDS,” said Michael Weinstein, President of AIDS Healthcare Foundation. “In addition, these draconian cuts—$170 million in total from the General Fund—will also trigger $322 million in additional lost matching federal and private AIDS dollars. The state is destroying a crucial public health safety net by decimating over $400 million in AIDS treatment, care and support services. And in the end, the state will still be responsible for the care of many of these patients who will end up seek far more costly care in overloaded emergency units throughout the state. These cuts would be catastrophic if they are implemented.”

Governor Schwarzenegger’s budget proposal wipes out $170 million that the Legislature appropriated for General Fund-supported AIDS programs, including $96 million for the jointly funded state/federal AIDS Drug Assistance Program (ADAP) which serves over 35,000 low income Californians. The state currently gets $88 million in matching ADAP federal funds; however, in order to receive these matching funds, California must meet a ‘maintenance of effort’ requirement, and by cutting all state ADAP funding, the state fails this requirement and will lose out on the $88 million in matching federal dollars.

The state’s elimination of all ADAP funding will also mean a loss in rebates from drug manufacturers who sell AIDS drugs to the state. These rebates add millions of dollars to a special ADAP fund. This rebate fund has had as much as $233 million in at one point, money which also goes toward AIDS services. If the state halts all drug purchases for ADAP, this additional funding stream for AIDS treatment, care and services also dries up. The state’s action will trigger a huge across the board loss of funding—a significant portion of which isn’t even state money—for the care of some of its most vulnerable citizens living with HIV/AIDS.

The Governor’s proposal also cuts the entire $8 million budget of the Therapeutic Monitoring Program (TMP). TMP provides diagnostic assay testing to help determine the efficacy of an individual's AIDS drug treatment protocol. The HIV Diagnostic Assay Program had been threatened in 2004 with an 87% cut, but Governor Schwarzenegger interceded at that time and restored most of the funding for this crucial AIDS testing program in his 2005 budget.

Advocates and patients from AIDS Healthcare Foundation (AHF), the nation’s largest non-profit HIV/AIDS healthcare provider, claimed victory after a quickly mobilized online grassroots campaign to persuade Los Angeles County public health officials to continue funding a crucial healthcare safety-net for some of the County’s most vulnerable AIDS patients prompted the County restore more than $1 million in funding for vital AIDS medical services that was to be cut from local service providers. Late last week, the Los Angeles County Commission on HIV voted to restore the $600,000 funding cut slated for medical services as well as restoring an additional $400,000 for other core AIDS services. The County’s Board of Supervisors will now vote on Tuesday to confirm the restoration of the funds—despite the fact that the Board was to be presented, and vote on, a previous motion that would have made the cuts to lifesaving AIDS service official at its meeting last week.

Thanks to the public’s participation in the innovative online campaign—which generated over 600 email letters as well as numerous telephone calls in just a matter of hours sent to Dr. Jonathan Fielding, Director of Public Health and Health Officer—Los Angeles County’s Department of Public Health halted its planned cuts to programs providing direct HIV/AIDS medical care, including the provision of lifesaving AIDS drugs.

“After AHF went public with its online campaign to stop cuts to vital AIDS medical services, County health officials quickly scrambled and realized that $2.5 million in additional Ryan White CARE Act funding that Los Angeles was receiving from the federal government made it possible for the County to restore the funding,” said Michael Weinstein, President of AIDS Healthcare Foundation. “After a harsh spotlight was shone on the ill-advised cuts to these vital health care services for people with HIV/AIDS, the Los Angeles County Commission on HIV voted to restore the funding, and the Board of Supervisors now appears set to vote to confirm the Commission’s action overturning the cuts at its meeting today. The County’s swift action followed closely on the heels of our online advocacy campaign—including the all important e-letters and calls of hundreds of people.”

County officials indicated to service providers as far back as January that they intended to slash funding for crucial AIDS medical services, but official news of the cuts to AHF and other providers came in a letter from County health officials just two weeks ago. Dr. Fielding, L.A. County’s Director of Public Health, now asserts that County officials planned all along to restore this AIDS funding; however, lifesaving care and services for some of the County’s most vulnerable citizens most certainly would have been interrupted has the Board of Supervisors voted to first institute these draconian cuts and then subsequently voted to restore the funding.

“At best, the County’s handling of this issue has been inept,” added AHF’s Weinstein. “It seems one hand of the L.A. County bureaucracy doesn’t quite know what the other is doing: The County sent official letters two weeks ago to notify AIDS service providers of the County’s intent to dramatically slash AIDS funding; at the same time, officials in the very same departments were aware of the receipt of the additional federal Ryan White funds coming to L.A. that are now making it possible for the County to halt those cuts. At very least, it seems the County could have avoided unnecessary paperwork—and community anxiety—by shortstopping the initial motion for the Board of Directors that was intended to enact the cuts.”

The cuts would have come at a time when fully half of all people living with HIV are not receiving treatment for their disease, and as a result, may be far more infectious and spread their infection to others. AHF had planned an administrative challenge to halt the cuts; but rallying HIV/AIDS patients, advocates and the public at large via the online campaign to press County officials to stop cuts to vital AIDS medical care seemed to have the intended effect of reversing the County’s actions.

The intent of the Ryan White CARE Act (where the money to offset the cuts is coming from) is to help communities nationwide pay for and deliver HIV/AIDS medical care and services to people in need who have few resources. The Ryan White Act is the law that directs the federal government to fund the majority of domestic HIV/AIDS care and services.

AIDS Healthcare Foundation (AHF), the largest non-profit HIV/AIDS organization in the US which currently provides medical care and services to more than 100,000 individuals in 21 countries worldwide in the US, Africa, Latin America/Caribbean and Asia, and which has been critical of President Obama’s silence on AIDS throughout his first hundred days, today lauded the President’s appointment of New York City Health Commissioner Dr. Thomas Frieden as head of the Centers for Disease Control.



“Dr, Frieden brings real world experience from the fight against AIDS in New York City to the CDC, skills we sorely need if we are ever going to effectively address the growing epidemic here at home,” said Michael Weinstein, President of AIDS Healthcare Foundation. “In New York, Frieden has been a strong advocate of routine testing for HIV and a supporter of the CDC’s 2006 guidelines to test all people ages 13-64 in routine health care settings; unfortunately, these testing guidelines have not been widely implemented at the same time when our rate of new HIV infections has increased from 40,000 new infections annually to 56,000. Demanding nationwide compliance with the CDC’s own prudent HIV testing guidelines is a great place for Dr. Frieden and the Administration to start.”



Over the past several weeks, many AIDS groups, including AHF, have been speaking out publicly about the fact that the Obama Administration had said virtually nothing of substance on AIDS, while in a multitasking masterpiece, his Administration somehow managed to launch dozens of other new initiatives—stem cell research, lifting an abortion gag rule, carbon emissions, Cuba, etc.—while remaining largely mute on AIDS.



“A recent study revealed that the HIV prevalence rate in Washington, DC has climbed to 3%—a higher rate of infection than found in many West African nations. One would think this news presented a natural moment for the President to speak out in his new adopted hometown about AIDS; yet the President remained silent, and a golden opportunity to highlight the huge AIDS problem facing our own country was lost,” added Weinstein. “AHF has previously expressed our disappointment with President Obama’s silence on AIDS during his first hundred days; we hope that Dr. Frieden’s appointment as head of the CDC indicates that the President is ending his silence on AIDS and will engage and address the HIV/AIDS epidemic domestically and globally.”



There are approximately 1.2 million people in the US living with HIV/AIDS today. More than 300,000 of these individuals have never had an HIV test and therefore do not know their HIV status. In August, the Centers for Disease Control (CDC) released stark new data showing an alarming 40% increase in HIV infections in the US annually (56,000 new cases each year up from a previous estimate of 40,000 cases annually). These numbers are a scathing indictment of how profoundly U.S. and CDC HIV prevention efforts have failed over the years.

County’s Department of Public Health including Dr. Jonathan Fielding, Director of Public Health and Health Officer for the County, as well bureaucrats from the Office of AIDS Programs and Policies (OAPP) over their recent move to slash over $600,000 in funds for direct patient care services—including HIV/AIDS medical care and the provision of lifesaving antiretroviral AIDS drugs—to some of Los Angeles County’s most vulnerable residents living with HIV/AIDS. The move comes despite the fact that County bureaucrats recently received both federal stimulus money and over $2.5 million in additional Ryan White CARE Act funds—federal funding specifically intended for HIV/AIDS prevention, care and services. Most advocacy groups that consider President Obama to be a likely friend in the White House have been patient as he finds his footing. Not so the AIDS Healthcare Foundation, a Los Angeles group that runs pharmacies and treatment centers and relies on government contracts and other health care spending.

Late last month, the foundation began running TV ads in New York and Washington accusing Obama of “silence on AIDS.” In fact, according to foundation president Michael Weinstein, as president Obama has yet to mention the term “AIDS.”

Because the disease is mostly associated in the United States with homosexuals and drug use, Weinstein says, administration officials may be avoiding the issue. “I think they’ve made a political calculation that it’s not in their best interest to put this front and center,” he said.

The foundation is just as disappointed with the administration’s deeds as with its words. The White House and Democratic leaders, for instance, helped scuttle a plan by Democratic Sen. Tom Harkin of Iowa to direct $400 million in economic stimulus spending to AIDS testing and prevention. Other stimulus money the foundation had hoped would be used for AIDS testing is slated to go toward smoking-cessation programs instead.

Moreover, Weinstein’s group is concerned that Obama hasn’t reversed President George W. Bush ’s directive for abstinence-only sex eduction.

Other AIDS activists are more willing to wait. Rebecca Haag, executive director of AIDS Action, has met with the director of the White House’s Office of National AIDS Policy, Jeffrey Crowley, and is collaborating with him on AIDS-prevention programs. “After eight years in the wilderness, it’s going to take us a while,” she says, adding that now AIDS activists are “openly embraced” by the administration.

But Weinstein says the administration has put AIDS disturbingly low on its priority list. “They struck down the ban on stem cell research. They struck down the gag rule for abortion,” he says. “This is of equal importance.”

Earlier this month AHF, the largest non-profit HIV/AIDS organization in the U.S. which currently provides medical care and services to more than 100,000 individuals in 21 countries worldwide in the U.S., Africa, Latin America/Caribbean and Asia, expressed its deep disappointment regarding the administration’s first—and so far, only—action on the issue: a proposal to spend $45 million over five years on a national communications campaign. At the time of the initiative’s announcement Weinstein noted: “There are approximately 1.2 million people in the U.S. living with HIV/AIDS today. Nearly 300,000 of these individuals are unaware of their HIV-positive status. A $45 million dollar communications plan—no matter how well intended—will do little to help identify the estimated 300,000 infected individuals in the U.S. who may unknowingly be infecting others.”

In addition to expressing disappointment, AHF renewed its call President Obama, HHS and the CDC to appropriate $200 million to test ten million people in the U.S. for HIV over the next three years.

Since first learning of the threat to Positive Healthcare’s existence in mid-December, AHF has been spearheading a multi-pronged campaign to save the AIDS care plan. This public awareness effort has included lobbying visits to state legislators’ offices by Positive Healthcare patients and nurse case managers; the filing of a lawsuit in mid-February in the Superior Court of the State of California, County of Los Angeles (case #BS 119149) to legally halt the forced closure of the plan; and an innovative grassroots media and web-based awareness campaign intended to alert the public-at-large to this short-sighted and punitive bureaucratic move by state health officials. Yesterday, AHF posted a video parody of Governor Schwarzenegger that plays off an image from his film star days as “The Terminator.” The 60 second parody will also start airing as a paid TV commercial on select television stations in Sacramento and Los Angeles.
History of Positive Healthcare

AHF first established its Positive Healthcare program in California on April 1, 1995, when it introduced a groundbreaking Medicare Managed Care Plan—a ‘Special Needs Plan’ health care program—specifically designed for people living with an AIDS-defining illness who also lived in the Medi-Cal-designated service area of Los Angeles County, the only region AHF offered medical care and services at that time. Actor and activist Blair Underwood will join thousands of caring individuals from across the state for Florida AIDS Walk this Sunday March 15th in Ft. Lauderdale starting and ending at Huizenga Plaza. According to a recent “Dear Colleague” letter issued by the Florida Department of Health, regarding the latest HIV/AIDS statistics: “…the Bureau of HIV/AIDS calculates approximately 5,550 Floridians were newly infected with HIV in 2006. The new estimate indicates that 36.4 of every 100,000 Floridians aged 13 years and older were newly infected with HIV in 2006. This rate is more than 60 percent higher than the national rate of 22.8 per 100,000 population.”

AIDS Healthcare Foundation (AHF), which operates the largest community-based alternative HIV and sexually transmitted disease (STD) testing program in California, has launched an innovative and eye-catching Los Angeles-area HIV prevention and testing campaign urging the public to “Stay Negative” and to visit www.freehivtest.net to find out where to get tested quickly, conveniently and at no cost.

The campaign, created by AHF, features billboards (12’ X 25’and 26’ X 24’), palm cards, radio spots and a significant online presence which, in addition to its own website, includes banner advertisements on KIIS, HOT, MYFM radio station websites. The attention-grabbing image of a semi-nude male with the words “Stay Negative” tattooed on his upper back is already having an impact. An increase in traffic to the www.freeHIVtest.net website has also coincided with an increase in testing at AHF sites.

“A major goal of the Stay Negative campaign is to help guide a shift in thinking around HIV testing. With its eye-catching image and simple, straightforward message, our hope is that the initiative will lead people to see HIV testing as a necessary and routine part of their health care—especially when they realize how easy it can be to access testing and obtain this crucial knowledge about their own status,” said Whitney Engeran III, Director of Public Health Division for AIDS Healthcare Foundation. “There are many uncertainties when addressing people’s sexual behaviors but the one thing we know for sure –HIV testing, detection and linkage to medical care works. The best way to break the chain of infection—in Los Angeles or anywhere—is for people to get tested and know their status.”

A key component of the initiative is its website which contains crucial information about HIV transmission, prevention and treatment, including facts about condom use. The site also contains an extensive “myth vs. reality” section that frankly addresses false beliefs surrounding HIV that may prevent some individuals from accessing testing. Most importantly, the site lists AHF’s free, community-based HIV testing locations including its Men’s Wellness Center in Hollywood, select Out of the Closet Thrift Store locations and through its innovative mobile testing van that appears at public locations throughout the city including sites such as Target, Big Lots, local area churches, Food4Less, and Ross in areas of town that include Long Beach, Atwater, East Los Angeles, Venice, Inglewood and West Hollywood.

“The ‘Stay Negative’ campaign is just the beginning of AHF’s year-long effort to test 40,000 people in Los Angeles for HIV by working with community-based partnerships such as the City of Los Angeles, Bienestar Human Services, the Wall De Las Memorias, Homeless Healthcare, Reach L.A. and other agencies,” said Joey Terrill, AHF’s Domestic Testing Program Manager. ”AHF’s own recent success with a 24-hour HIV testing event at our Sunset Blvd. Out of the Closet Thrift Store in honor of World AIDS Day 2008, made it clear that people want to be tested, especially if testing is made accessible. California is leading the way in implementing legislation to make routine HIV testing a reality as recommended by the Centers for Disease Control’s (CDC). In September 2006, the CDC issued a landmark revision to its HIV testing recommendations encouraging U.S. medical providers to make HIV testing a “routine part of care in health care settings for all patients ages 13 through 64,” and encourages linkages to care and treatment for those found to be HIV infected. The CDC also suggested that, “(HIV)... screening should be routine, regardless of whether the patient is known or suspected to have specific behavioral risks for HIV infection.”

According to a recent CDC report on the nation’s HIV/AIDS epidemic, there was a 15% increase in new cases of HIV/AIDS infections in 2007 (38,531 in 2006; 44,084 in 2007). From 2003 through 2006 this number was stable at roughly 38,000. The report cites new HIV reporting regulations in states and increased testing as the reason for the increase, but does not rule out that it may be due to an increase in new HIV infections.

On Friday night, AIDS Healthcare Foundation (AHF) hosted a kick-off event to declare February 13th World Condom Day and distributed 20,000 free Valentine’s Day-themed “LOVE” condoms via its “LOVE Condom Mobile” along Sunset Strip in West Hollywood. The event took place in the heart of the Sunset Strip at 8410 Sunset Blvd. (at Kings Rd.) underneath the “jumbo-tron” on which AHF premiered a condom TV ad that was rejected by Fox Television. Earlier in the day, AHF hosted a press conference and teleconference to challenge the Los Angeles FOX Television network affiliate’s refusal to broadcast a straightforward, fact-based 30 second television advertisement in which actress and AIDS activist Sheryl Lee Ralph discusses the importance of condom use and HIV testing. AHF tried to purchase commercial time during the Sunday evening broadcast of FOX’s popular animated series “Family Guy’ a shown known for its raunchy and racy content.

FOX’s unexpected refusal to broadcast AHF’s paid HIV prevention advertisement during this Sunday’s prime time ‘Family Guy’ episode coincides with the group’s previously planned Valentine’s Day condom campaign Friday February 13th—which will kick off as scheduled in West Hollywood Friday evening starting at 9:30pm. That event will include the distribution of 20,000 free Valentine’s Day-themed ‘LOVE’ condoms along West Hollywood’s bustling Sunset Strip by street teams of AIDS advocates and via AHF’s ‘LOVE’ Condom Mobile.

“The rejection of this quite wholesome and straightforward public health message by the LA FOX affiliate is the height of hypocrisy given the amount of sexual content found in its entertainment program lineup including ‘Family Guy’,” said Michael Weinstein, President of AIDS Healthcare Foundation. “On any given day or night, Viagra and other erectile dysfunction ads run regularly on FOX—there seems to be no squeamishness about FOX airing shows like ‘Family Guy’ or selling commercial time to promote sex. However, FOX now draws the line when we try to promote condoms as a means toward HIV prevention. We strongly urge FOX to reconsider their misguided censorship of this commercial.”

AHF also submitted the television spot to The Los Angeles Time Warner Cable group to review the spot for the following networks: MSNBC, CNN, MTV, Lifetime, BET and TBS. They approved the spot for airing in any day part on all stations.

In an example of the sharp contrast between AHF’s straightforward public health television commercial and the racy, off-color content of FOX’s prime time ‘Family Guy’ series, the watchdog advocacy group, Parents Television Council pulled the following dialogue from the show:
• “I’ll bet you can’t get a boner”, which was replied to by “That’s not very nice, Brian”, to which “Brian replied, “Neither is your mother’s ass.”
• In another episode, Mr. Herbert, a “pedophile” babysitter …responds (to Chris, the older son on the series), “Don’t you mouth off to me or I’m going to smack you right in your penis.”

According to the website Wikia Entertainment, FOX’s ‘Family Guy’ has even gone as far to use the word “condom” in its own script dialogue. In the episode, "Emission Impossible", (Season 3, Episode #11) it is revealed that Chris was born as an accident, due to a broken condom.

In comparison, the script for AHF’s rejected HIV prevention commercial reads, “Hello, this is Sheryl Lee Ralph. Let’s talk. Let's talk about ...HIV. Ambitious World AIDS Day Campaign Led by AIDS Healthcare Foundation Far Surpasses Goal of One Million Tests; Shatters Myths about Streamlined Testing & Counseling Models

A groundbreaking global effort led by AIDS Healthcare Foundation (AHF) to test one million people for HIV as part of a global testing campaign tied to the recent observance of World AIDS Day (December 1st) has far surpassed its goal by testing more than 1.5 million people and identifying more than 61,000 HIV-positive individuals in more than 25 countries around the world. The ambitious month-long campaign spearheaded by AHF, the largest AIDS group in the US, also shattered myths and prejudices concerning the use of streamlined HIV testing and counseling models as well as the mass mobilization of targeted groups and populations who would benefit from such free HIV testing and counseling. The 61,000 positives identified out of the more than 1.5 million people tested resulted in an overall 3.9% sero-positivity rate.

“Our ‘One Million Tests’ campaign exceeded its goal by more than half a million tests, a truly remarkable accomplishment. In the process, over 61,000 HIV-positive individuals were identified and referred to treatment,” said Michael Weinstein, President of AIDS Healthcare Foundation, “I am gratified by the success of our campaign, which demonstrates what can be achieved by using new HIV testing models as well as mass mobilization efforts. With so many millions of lives at stake, we need to educate and encourage people to test. As public health leaders, we need to be bold and open-minded to save lives.”

“Sincere thanks to all the NGOs, government agencies, partners and individuals around the world who joined us to help make the ‘One Million Tests’ World AIDS Day campaign a resounding success,” said Terri Ford, Director of Global Advocacy for AHF and Coordinator of the ‘One Million Tests’ campaign. “By working together in many innovative public/private partnerships, this campaign helped shatter the notion that stigma is an insurmountable barrier. The lines and queues of people waiting for testing were a testament to both the need and the desire of many to stay well and healthy for their families. We know that testing is the gateway to treatment and to keeping parents alive and well enough to raise their children.”

In India, Mexico and Uganda, AHF and select partners utilized a groundbreaking new testing tool, a one minute, finger stick blood serum test known as the INSTI test made by Canada’s bioLytical Labs. This testing technology drastically reduces wait time for results while significantly increasing the volume of clients accessing testing services.

AHF kicked off the ‘One Million Tests’ campaign during the International AIDS Conference in Mexico City last August, recruiting many global partners from among the 20,000 participants at the conference. The testing itself started in Cambodia in mid-November in conjunction with that country’s national holiday, the Water Festival.

“I attended the conference in Mexico and signed in for Mumbai, but sharing the news about this campaign, all locations in India expressed their interest and so it started,” said Diane Mailto, Population Services International—India (PSI-India).

“…RTI International (RCT/BC project) Kasese successfully performed 3,595 HIV tests during the One Million Tests campaign. We exceeded our projected target of 2,200… Uganda Cares/AHF provided us with HIV test kits & testing supplies, T-shirts, and funds for mass mobilization & allowances for health workers. Their timely logistical and financial support was key to our success.” Dr. David Tumuhairwe, RTI International.

“Not only does antiretroviral treatment save the lives of people living with HIV/AIDS, it also helps prevent further transmission of the virus. Our partners in this campaign helped forge a dynamic and diverse new testing coalition with a united voice. The ‘One Million Tests’ campaign serves as a catalyst for a worldwide commitment to free and easy HIV testing and improved access to lifesaving antiretroviral treatment worldwide. We are proud to have far exceed the one million tests goal; however, this is just the beginning,” added AHF’s Ford.

There are currently 33 million people worldwide thought to be living with HIV/AIDS. Of these, only about three million people in the developing world have access to lifesaving antiretroviral AIDS medications. The vast majority the remaining 30 million people living with HIV/AIDS worldwide have never been tested for the virus.

AIDS Healthcare Foundation (AHF), the nation’s largest AIDS organization, expressed its disappointment that Senate Democratic leaders agreed to remove a provision from the stimulus bill allocating $400 million for prevention of sexually transmitted diseases, including HIV testing. In January, AHF has meetings with 60 Congressional offices where it brought medical providers and people with HIV/AIDS to explain the need for, and the stimulative impact of, this funding.

“It is disappointing that this money, which will create jobs, and save billions in medical costs, is currently not part of the Senate version of the bill, “said Tom Myers, AHF’s General Counsel. “What is particularly dismaying is that people have been allowed to attack this provision as immoral or promoting immorality, and no one has stood up to explain why this is good stimulus, and good policy.”

“The stimulus part of the testing proposal is quite simple: Increasing HIV testing means increasing jobs. It means increasing the number of nurses in emergency rooms, who are needed to do the tests. It means jobs on the production lines of the test makers, who are in America.

“And, unlike other stimulus, testing not only creates jobs, it not only prevents people from becoming infected, it saves money. The lifetime medical cost for a person with HIV is about $600,000. Most of the AIDS infections in this country come from people who don’t know they have it. If we increase the number of people who know they have HIV, there will be fewer infections. We proposed that spending $300 million on increasing HIV tests would prevent enough infections to save over $3.6 billion,” said Michael Weinstein, AHF’s President.

Under AHF’s proposal, $300 million would be spent over the next two years to purchase the kits, and hire the staff, to do three million tests. This would identify approximately 60,000 people with HIV who do not know they have it. A study produced by the National Institutes of Health found that, when a similar number of people became aware of their status, it resulted in 6,000 fewer infections. At $600,000 in lifetime medical costs for each HIV infection, that saved $3.6 billion.

“There is no other stimulus proposal that will create jobs, will prevent infections of a potentially fatal disease, and will also save many times its original outlay. AHF will not allow this provision to be the victim of culture war demagoguery, and will continue advocating for its inclusion in the stimulus,” added Myers.

The video features a mock interview with an Abbott executive and utilizes a publicly-available image of Abbott CEO Miles D. White. By contrast, video content deemed “appropriate” by YouTube this week (as evidenced by the fact that it remains on the site) includes the PETA commercial recently banned from appearing on network television during the Super Bowl due to its strong sexual content.



In conjunction with the release of the parody video, AIDS advocates from three countries—Colombia, Mexico and the United States—held simultaneous protests yesterday in each of the three countries targeting Chicago-based pharmaceutical giant Abbott Laboratories over the pricing of its key AIDS drug, Kaletra. Abbott charges $1,000 per patient per year for Kaletra in most middle-income countries and $500 per patient per year in low-income countries. In Mexico and Colombia, Abbott charges $5,400 and $3,500 per patient per year, respectively, keeping it far out of reach for people living with HIV/AIDS in those countries.

As part of an ongoing multinational campaign to lower drug prices and improve access to lifesaving AIDS treatments globally, AIDS advocates from three countries—Colombia, Mexico and the United States—are holding simultaneous protests today in each of the three countries targeting Chicago-based pharmaceutical giant Abbott Laboratories over the pricing of its AIDS drug, Kaletra, which can be a key component of lifesaving AIDS drug treatment regimens, particularly as part of what are known as ‘second-line’ treatments and salvage therapy.



Advocates from AIDS Healthcare Foundation (AHF), the group coordinating the US protest in the Chicago area (which is being supported by local student activists who have been involved in the AIDS drug pricing issue) will also release a sixty second video parody lambasting Abbott and its CEO, Miles D. White over the drug giant’s continuing coldhearted actions on the pricing of its key AIDS drugs. The video parody will premiere publicly for the first time when it is posted on YouTube Wednesday in conjunction with the coordinated international protests in the three countries. “People may not be aware that Abbott is abusing NAFTA’s patent protections to charge five times as much for Kaletra in Mexico as it does in other middle-income countries, keeping this lifesaving drug out of reach for nearly all those living with HIV/AIDS in Mexico,” said Michael Weinstein, AIDS Healthcare Foundation President. “We hope these simultaneous international protests in Mexico, Colombia and the US will help bring about an end to Abbott’s price-gouging policies in Mexico and Colombia that shamefully continue to place profits ahead of saving lives.”



“Many patients living here in Mexico depend on access to drugs such as Kaletra that are available elsewhere at a much, much lower cost,” said Patricia Campos, M.D., AIDS Healthcare Foundation’s Latin America Bureau Chief, who is based in Mexico and is a principal coordinator of today’s Abbott protest in Mexico City. “We are strongly urging Abbott to immediately lower the price of Kaletra in Mexico to equal the price offered to Brazil in order to ensure that people in need in Mexico are not priced out of such potential lifesaving AIDS treatments.”



“Through these coordinated, grassroots international protests today, we want to loudly and clearly remind Abbott, its employees and the general public that the lives of people living with—and dying from—HIV/AIDS in Mexico and Colombia are just as important as those of people living with AIDS here in the United States. As a result, we are asking Abbott to reduce the price of Kaletra in those two countries,” said Terri Ford, Director of Global Advocacy for AIDS Healthcare Foundation. “We literally want to bring this message home to Abbott and its executives. That is why our Chicago protest is taking place in front of the Lake Forrest home of Abbott CEO Miles D. White.”



Abbott has long been the target of multinational protests and legal actions over the pricing of its AIDS drugs including Kaletra and Norvir. Over the past several years as many of Abbott’s industry peers have significantly lowered the prices of their own lifesaving AIDS medicines on their own volition and in response to worldwide humanitarian need, Abbott has remained steadfast in its refusal to do so, or it has countered advocates’ and governments’ demands with only modest price reductions.



According to the website, www.aidsmeds.com, “Kaletra, a protease inhibitor (sold under the brand name Aluvia in some parts of the world), is actually two drugs combined into a single capsule: lopinavir and low doses of ritonavir (Norvir), another protease inhibitor manufactured by Abbott Laboratories. This is because ritonavir increases the amount of lopinavir in the blood, thus making it more effective against HIV.”



Abbott Laboratories and Kaletra



• Abbott’s Kaletra (lopinavir/ritonavir) is considered to be the premier second-line treatment for HIV worldwide due not only to its efficacy and low side-effects but also its reduced pill burden. Due to its high price (typically four to six times more than other treatments) it is not been widely included in national treatments programs and those who developed resistance to other treatments in these countries have had few options.



• Worldwide sales of Kaletra in 2006 alone were over $1 Billion, while projections estimate the market for HIV Drugs to reach $10 Billion by 2015.



• Abbott charges $1,000 per patient per year for Kaletra in most middle-income countries and $500 per patient per year in low-income nations. Generic lopinivar/ritonavir costs $600 per patient per year. In Mexico and Colombia, Abbott charges $5,400 and $3,500 per patient per year, respectively. On January 28, 2009, activists in Mexico, Colombia, and the United States will petition Abbott to lower these prices and the respective governments to break the patents country so that the medicine is available to all who need it. 21,000 people per year die of AIDS in the two countries.



Kaletra in Mexico



• Mexico is a middle income country with an average income per capita of $7,454 per year. 200,000 people are living with AIDS. HIV prevalence is 0.3% and 11,000 people die each year die from AIDS in the country.



• Mexico is unable to provide antiretroviral therapy to those who need it. UNAIDS estimates that 33,000 people with AIDS who need ARV therapy now (43% of the total), are not currently accessing it in Mexico. Mexico’s government is spending $155 million each year for AIDS drugs.



• Abbott charges Mexico an exorbitant $5,400 per patient per year, the same price it charged in 2003. This over 5x the $1,000 per patient per year which it charges in other countries in Latin America (Including Brazil, Honduras, Guatemala, El Salvador, Peru, and Ecuador) and over 10x the price it charges in Africa, Haiti, and Cambodia.



• In contrast, ALL other drug companies have offered significant price reductions on their medications. Advocacy and negotiations between the Mexican Government and the major pharmaceutical companies resulted in significant drops in price in 2008 alone. For instance, GlaxoSmithKline accepted a 40% price reduction for Abacavir while Merck, Sharpe, and Dohme accepted a 40% price reduction for Efavirenz.



• The Mexican Coalicion de Activistas por el Aceso Universal en VIH/SIDA demands that Abbott reduce its prices and the Mexican Government to issue a compulsory license for Kaletra.



Kaletra in Colombia



• Colombia is a lower-middle income country with an average income per capita of $2,600 per year. The country has one of the most serious HIV/AIDS problems in the region: 170,000 people living with AIDS and a rapidly rising HIV prevalence (currently 0.7%). An average of 10,000 people each year die from AIDS in the country.



• Colombia is unable to provide antiretroviral therapy to those who need it. UNAIDS estimates that 33,000 people with AIDS who need ARV therapy now (62% of the total) are not currently accessing it. Colombia’s government is spending $70 million each year for AIDS drugs (all national funding).



• Abbott promotes Colombia as receiving a preferred price of $1,000 per patient per year for lower-middle income countries on its website. However, in reality Abbott charged Colombia $8,400 per patient per year up through mid-2007. Abbott is currently charging $3,500 in Colombia.



• Abbott uses unorthodox and unethical marketing strategies in Colombia to promote Kaletra. This includes offering classes, dinners, and trips to patients on Kaletra. As a result, Kaletra is the 2nd-most widely prescribed AIDS medicine in Colombia, highly unusual for a 2nd-line medication. Kaletra accounts for 1/3 of Colombia’s AIDS drug costs.



• On April 7, 2008, the Mesa de Organizacions con Trabajo en VIH/SIDA and the Red Colombiana de Personas Viviendo con VIH o con SIDA requested an open license on Kaletra. The local Colombian generics industry has the capacity to manufacture Kaletra at much lower costs AND Colombia has an agreement with the Clinton Foundation through which it could get a generic version of Kaletra for approximately $600 per patient per year. Abbott did not respond.



• The Mesa de Organizaciones con Trabajo en VIH/SIDA, the Red Colombiana de Personas Viviendo con VIH o con SIDA, Mission Salud, and IFARMA requested a compulsory license for Kaletra from the Ministry of Commerce. The Ministry of Commerce has requested the Ministry of Social Protection to rule whether or not Kaletra is a medication “in the public interest.” The ruling is expected in early 2009.

AIDS Healthcare Foundation (AHF) lauded the United States House of Representatives today for adopting AHF’s proposal to appropriate $300 million in the pending economic stimulus legislation and dedicate it for HIV/AIDS prevention, testing and services. Yesterday, the Democratic leadership of Congress proposed $355 million for domestic HIV/AIDS, viral hepatitis, STD and prevention programs as part of a $3 billion Prevention and Wellness Fund to prevent diseases and to reduce future healthcare costs. The funding proposal is included in the House of Representatives’ American Recovery and Reinvestment Bill of 2009. The legislation is a cornerstone of the economic recovery efforts being championed by President-elect Obama who is working closely with Congress to implement an effective and durable program for economic recovery nationwide.

Since the beginning of the week, more than a dozen AIDS Healthcare Foundation nurses, AIDS patients, and medical providers from Florida were in Washington for a series of 55 meetings on Capitol Hill with Senate and Congressional leaders to lobby Congress to include funding for HIV testing throughout the hard-hit South as part of the nation’s economic stimulus legislation. The visiting Florida delegation lobbied for funding for an expansion of the current Centers for Disease Control (CDC) HIV testing program to do over three million HIV tests in the next two years in order to find the 60,000 plus people currently infected with HIV but who don’t know it. AHF estimates that doing so will prevent at least 6,000 new infections, ultimately saving the government billions of dollars in medical costs.

“Congress has done the right thing by including funding for crucial public health programs in the stimulus,” said Michael Weinstein, President of AIDS Healthcare Foundation. “The CDC now estimates that there are 56,000 new infections each year, up from the previously-estimated 40,000 new cases per year. These infections result in billions of dollars in medical care and lost productivity of these individuals over the years, a fact that supports investing in prevention, testing and health care as part of a prudent overall legislative economic recovery package.”

“We are very pleased with the inclusion of funding for AIDS, STD, viral hepatitis and prevention services. But this House bill also contains $462 million for building construction at the Centers for Disease Control and Prevention,” noted Whitney Engeran, III, Director of AIDS Healthcare Foundation’s Public Health Division. “Rates for many STDs are up dramatically, particularly among minorities and youth, as a new CDC report issued earlier this week documented. During our current economic downturn when so many people have lost jobs as well as health insurance coverage, AHF strongly urges legislators to reconsider funding building and reconstruction at the CDC and redirect that funding to other crucial initiatives within the CDC that actually help people in need.”

Alarming new statistics from the Centers for Disease Control (CDC) regarding sexually transmitted disease rates in the US show a steep jump in many STDs including Gonorrhea, syphilis and chlamydia, particularly among minority and youth populations. These stark numbers suggest that the incoming Obama Administration and its yet-to-be named Director of the CDC must quickly implement proven and effective prevention strategies such as safer sex messages and the widespread promotion of condom usage rather than continuing it disproportionate reliance on what has been to be proven to be largely ineffective abstinence-only strategies.

“We do a profound disservice to today’s youth by denying them crucial information about how to protect their own health, and these latest CDC numbers are a scathing indictment of our country’s failed public health policies over the past eight years,” said Michael Weinstein, President of AIDS Healthcare Foundation. “President-elect Obama must empower his incoming CDC Director to quickly revamp failing STD prevention policies and adopt science-based strategies that actually work to prevent disease. As the HIV/AIDS epidemic continues to have a disproportionate—and devastating—impact throughout the Southern United States, a group of AIDS patients, nurses and medical providers from Florida are visiting Washington, DC this week for a series of meetings on Capitol Hill with Senate and Congressional leaders to lobby Congress to include funding for HIV testing throughout the hard-hit South as part of the nation’s economic stimulus legislation currently being drafted. The group, all of whom are patients or medical providers of AIDS Healthcare Foundation (AHF), will lobby Congress for funding for an expansion of the current Centers for Disease Control (CDC) HIV testing program to do over three million HIV tests in the next two years in order to find over 60,000 people currently infected with HIV but who don’t know it. AHF estimates that doing so will prevent at least 6,000 new infections, ultimately saving the government billions of dollars in medical costs. The patients and medical providers lobbying Congress are from AHF’s Positive Healthcare program in Florida, the first disease management program of its kind in the United States specifically designed for Medicaid beneficiaries diagnosed with HIV or AIDS.

“The AIDS epidemic is an appalling situation across the Southern United States. The number of people who do not know their HIV status, the lack of access to testing and medical treatment, widespread stigma and discrimination—all have added up to a recipe for disaster in the region,” said Michael Weinstein, President of the AIDS Healthcare Foundation. “Through PEPFAR, President Bush’s landmark global AIDS program, the US has saved millions of lives and shown its generosity and compassion to the world. Here in the US, the Deep South remains our nation’s battleground in the fight against AIDS, and we need to do far more in this fight here at home. Calling for stimulus funding for the CDC to improve HIV testing efforts throughout the South is both prudent public health and prudent public policy.”

“People are not being routinely tested for HIV nationwide despite clear guidelines from the CDC that routine testing is the best practice. And many people with HIV, but who do not know it, particularly in the South, go to emergency rooms and clinics over and over again, but do not get tested unless—and until—they show symptoms of HIV/AIDS,” said Michael Kahane, Bureau Chief, Southern Region, US for AHF. “This is unfortunate, because when people do not know they have HIV or AIDS, they are far more likely pass on their infection to others. Also, when they finally get diagnosed, they are often very sick, so they can’t work, care for their family, and it is often much harder and more expensive to get their health back.”

“It is widely understood that knowing one’s HIV status helps prevent new infections. When individuals know they are HIV-infected, they take steps to reduce risk and protect others,” said Tara Barreto, RN, Director of Positive Healthcare Disease Management in Florida. “People who have had the opportunity to be tested and have tested positive can also begin taking lifesaving antiretroviral treatment, which helps them manage their disease and reduces the amount of virus in their system, which renders them much less able to infect others.”

The AHF contingent lobbying Congress for funding for HIV testing includes six Florida HIV/AIDS patients, nearly a dozen AIDS nurses, medical providers and other AHF officials. Members of the group will meet with legislators and staffers in 55 Senate and Congressional offices throughout the week.

Superior Court Judgment Commands California Department of Health to Comply with Landmark 2002 Law Providing Care for HIV-Infected Individuals, Compels State to Report Within 120 Days on Actions Taken

The Superior Court of California, County of Los Angeles has entered a judgment and will issue a writ ordering California’s Department of Health Care Services (DHCS) to implement a landmark 2002 law intended to extend Medi-Cal (Medicaid) coverage to HIV-positive Californians. In addition to detailing specific steps that must be taken in order to be considered in compliance, the Court has issued a writ commanding the Department to “…make and file a return to this writ within 120 days of issuance, setting forth what you have done to comply.”

Earlier this month, the Court ruled that the state’s Department of Health Care Services (DHCS) “…arbitrarily failed to meet its statutory duties…” in implementing the 2002 legislation. The ruling came in a case (#BS 108234) filed by AIDS Healthcare Foundation (AHF) which sought to compel the Department of Health Care Services to comply with legislation intended to extend Medi-Cal coverage to HIV-positive, non-disabled individuals who would otherwise qualify for Medi-Cal. Prior to the passage and signing of the legislation (California Assembly Bill 2197) only such individuals who had advanced to a diagnosis of AIDS were considered eligible for Medi-Cal enrollment and coverage.

“Despite an excellent record on AIDS issues, Governor Schwarzenegger has been ill-served by his administration which for six years has failed to enact this crucial—and ultimately cost-saving—health care legislation,” said Michael Weinstein, President of AIDS Healthcare Foundation, the US’ largest HIV/AIDS organization, which operates AIDS treatment clinics in the US, Africa, Latin America/Caribbean and Asia—including 12 clinics in California.. “We thank the court for this judgment which compels the state to do its job by implementing this important legislation passed by the state’s representative government and signed into law by the Governor.”

In the judgment, the Court orders the state to:

“1. Conduct all outreach and awareness activities necessary to encourage the voluntary enrollment into Medi-Cal managed care of persons who are disabled as a result of AIDS pursuant to Welfare and Institutions Code 14149.3, subdivision (g);
2. Determine the savings generated by the increased voluntary enrollment into Medi-Cal managed care of persons who are disabled as a result of AIDS pursuant to Welfare and Institutions Code 14149.3, subdivision (f) (1);
3. Establish capitation rates to be paid to Medi-Cal managed care plans for services provided pursuant to Welfare and Institutions Code 14149.3, subdivision (e);
4. Seek the appropriate federal waiver under Section 1115 of the Social Security Act (42 U.S.C. Sec. 1315) to implement the expansion of eligibility provided for pursuant to Welfare and Institutions Code 14149.3, subdivision (j); and
5. Take any further action specially enjoined on them by the law. Nothing in this judgment or in that writ shall limit of control in any way the discretion legally vested in respondents.”

The Need for Care for HIV-infected Individuals in the Early Stages of the Disease

AB 2197 came about in part in response to a call by the federal centers for Medicare and Medicaid Services for states to seek waivers to extend healthcare services to low-income individuals in the early stages of HIV. As written and signed into law back in 2002, AB 2197 directs California’s Department of Health Services to, among other things:

· Determine whether, under applicable Federal law, the federal government will contribute financially for the enrollment and maintenance of these beneficiaries in the Medi-Cal program;
· Seek from the federal government a waiver of requirements for the Medi-Cal program, such that California may implement this program;
· Actively encourage Medi-Cal recipients with AIDS to voluntarily enroll in Medi-Cal managed care programs;
· Utilize the savings generated by such enrolments to fund the coverage of otherwise eligible persons with HIV into the Medi-cal program.

History of California Assembly Bill 2197
In 2002, California Governor Gray Davis signed Assembly Bill 2197. The bill, which had been introduced twice before in the California legislature in various versions as far back as 1997, honored a campaign pledge Davis made during his first California gubernatorial campaign.

At the time of its passage, AB 2197’s author, Assembly Member Paul Koretz (D, West Hollywood—retired), said, “This bill is a win-win for the state and for persons living with HIV. It will provide access to more reliable, stable health care for these individuals at no additional cost to the state. The strong bi-partisan support this bill has received is testament to the fact that it is a very sensible, cost-effective approach to improving access to health care.”

AB 2197 had been the highest priority that legislative year for California’s leading AIDS organizations including the Southern California HIV Advocacy Coalition (SCHAC), (the sponsor of the bill) representing 10,000 individuals throughout the Southland, and AIDS Healthcare Foundation (AHF), the nation’s largest specialty provider of HIV/AIDS medical care with clinics in Southern and Northern California.

AB 2197 extends Medi-Cal eligibility to Californians who are HIV positive, but do not yet have an AIDS defining illness. Previously, only Californians with an AIDS diagnosis (those who have progressed clinically from being HIV positive to having an AIDS defining illness) could be considered for Medi-Cal eligibility. As a result, many HIV-positive Californians had to progress to an AIDS diagnosis in essence get sicker, in order to then access care via Medi-Cal. Sadly, because of the state’s failure to comply with AB 2197 almost five years after its passage, this still largely remains the case today.

Sierra Leone AIDS Director Praises AHF for “One Million Tests/World AIDS Day 2008” Campaign

“Letter of Appreciation” from Director of National HIV/AIDS Council and Secretariat Acknowledges Successful Collaboration Which Resulted in 23,063 People Being Tested for HIV in Sierra Leone in the Week Leading Up to December 1, 2008

AIDS Healthcare Foundation (AHF) is proud to announce that it has received a “Letter of Appreciation” from the government of Sierra Leone expressing gratitude for AHF’s partnership in the recent “One Million Tests/World AIDS Day 2008” campaign. The worldwide campaign spearheaded by AHF, brought together 1000 global partners in 72 countries, including non-governmental organizations (NGOs), local and national governments, international relief agencies, faith-based organizations and civil society in a collaborative effort to conduct free HIV tests to one million people around the global in observance of World AIDS Day 2008.

Having made a commitment to provide 20,000 free HIV tests to its citizenry as part of the campaign, Sierra Leone’s National HIV/AIDS Council and Secretariat exceeded that goal by conducting 23,063 HIV tests in twelve districts in the week leading up to World AIDS Day, November 26th to December 1st 2008. In a remarkable collaboration between the government, non-profit and private sectors, these tests were conducted in part due to a successful partnership with Inverness Medical Innovations, Inc. who generously donated 10,000 “Determine” HIV tests, half of the total provided to the government of Sierra Leone. Funding for the additional 10,000 tests was provided by AHF.

In the letter, Dr. Brima Kargbo, MD, MPH, Director of the National HIV/AIDS Council and Secretariat, states: “I am pleased to inform you that Sierra Leone tested 23,063 people (9,424 males and 13,639 females). We are very much appreciative of the test kits that were made available for the exercise. We hope our collaboration will continue to be strengthened.”

“We humbly and gratefully receive this acknowledgement from the government of Sierra Leone and would like to return the compliment by praising the remarkable commitment of the National HIV/AIDS Council and Secretariat. We would also like to express our thanks to Inverness for its generous donation of 10,000 HIV tests to the Sierra Leone World AIDS Day effort,” said Terri Ford, Director of Global Advocacy for AIDS Healthcare Foundation. “To make this happen, AHF, the Sierra Leone government and Inverness united in a powerful trio of NGO, government and industry. This is a great example of how, with a united effort, great strides can be made in the fight against AIDS.”

Add Ms. Ford: “We are also pleased to announce that as a result of this successful partnership, AHF has been invited to meet with the Sierra Leone government in Freetown to discuss further collaboration for expanded testing and treatment services in the country.”
